Website Use

Acceptance & Access

By accessing or using this website, you agree to these Terms and
our Privacy Policy. If you do not
agree, please stop using the website.

You must be legally capable of entering into a binding agreement,
or use the website with the authority of the person or organisation

03
Information

Website Information

Website content is general information only. Images, drawings,
dimensions, capacities, speeds, finishes, features, performance
data and project examples are illustrative unless we confirm them
in a project-specific written document.

Website content is not engineering, architectural, building,
safety or legal advice. Elevator suitability must be assessed for
the relevant building, use, site conditions, traffic requirements,
applicable standards and approvals. Do not begin construction or
rely on website dimensions without written project confirmation.

04
Project Enquiries

Enquiries & Quotations

Submitting a form, calling us, emailing us or requesting a quote is
an enquiry only. It does not place an order, reserve equipment or
require either party to proceed.

  • A quotation is valid for the period stated in that quotation.
  • Scope, assumptions, exclusions, price and programme are those stated in the written quotation.
  • Any estimate or preliminary budget is indicative unless expressly identified as a fixed quotation.
  • We may clarify project information before issuing or accepting a quotation.
05
Agreement

Project Contracts

A binding project contract is formed only when the parties accept
a written quotation, proposal or agreement in the manner stated in
that document, or otherwise clearly agree to proceed.

The project contract may include an accepted quotation, scope,
technical specifications, approved drawings, payment schedule,
programme, warranty terms, variation documents and other documents
identified as forming part of the agreement. Those project
documents govern the relevant supply or services.

Products & Specifications

Product availability and specifications may change as engineering,
supplier, regulatory or project requirements develop. We may use
an equivalent component or update a design where reasonably
necessary, subject to the project contract, applicable law and any
required customer approval.

Final approved drawings, schedules and written specifications take
priority over catalogues, renders, photographs, display samples and
general website descriptions. Colours and finishes may vary between
screens, samples, production batches and site lighting.

07
Commercial Terms

Pricing, GST & Payment

Prices, GST treatment, deposits, progress payments, retention,
payment due dates and accepted payment methods are as stated in the
applicable quotation or project contract. Unless stated otherwise,
prices are in Australian dollars.

You must pay correctly issued invoices by the stated due date. If
an amount is genuinely disputed, please notify us promptly with
reasonable details and pay any undisputed amount when due. Any
interest, suspension right or recovery cost applies only where it
is stated in the project contract and permitted by law.

08
Your Project

Customer Responsibilities

You are responsible for providing complete, accurate and timely project information, including:

  • current plans, dimensions, structural details, service locations and site conditions;
  • the building use, expected traffic, accessibility and operational requirements;
  • relevant approvals, consultant instructions and programme constraints; and
  • safe and reasonable site access, facilities and coordination required by the project contract.

Tell us promptly if information changes. We are not responsible for
delay, redesign or additional work caused by inaccurate, incomplete
or late information to the extent reasonably attributable to that
information.

09
Programme

Timing, Delivery & Delays

Any programme or delivery date is subject to the assumptions and
dependencies stated in the project contract, including approvals,
site readiness, access, preceding works, manufacturing and supply.

If an event beyond a party’s reasonable control delays performance,
the affected party should notify the other as soon as reasonably
practicable and take reasonable steps to reduce the effect. Any
extension, cost or other consequence is determined under the
project contract and applicable law.

10
Site Services

Installation, Maintenance & Safety

Installation, testing, commissioning, modernisation, maintenance
and repair services must be performed in accordance with the
applicable project contract, approved documentation, site safety
requirements and applicable laws and standards.

Only authorised and appropriately qualified persons may access,
adjust or work on elevator equipment. Do not interfere with safety
systems or use equipment that has been isolated or identified as
unsafe. Emergency or entrapment procedures must be followed where
applicable.

11
Project Changes

Variations, Suspension & Cancellation

A requested change to scope, specification, quantity, programme,
access or site condition may require a written variation addressing
price and time. Neither party is required to perform a material
variation until it is agreed, except for urgent work reasonably
required for safety or to comply with law where the contract permits.

Suspension, cancellation or termination rights, including any
payment for work completed, committed materials or reasonable
demobilisation costs, are governed by the project contract and
applicable law. Nothing in this clause removes a statutory right
to cancel or obtain a remedy.

12
Australian Consumer Law

Consumer Rights & Warranties

Our goods and services come with guarantees that cannot be excluded
under the Australian Consumer Law. Nothing in these Terms or a
project contract excludes, restricts or modifies any guarantee,
right, remedy or liability under the Competition and Consumer
Act 2010
(Cth), the Australian Consumer Law or another law where
it would be unlawful to do so (Non-Excludable Rights).

Any express product, installation or service warranty is additional
to applicable Non-Excludable Rights and is governed by its stated
warranty terms. Warranty outcomes may depend on correct use,
operating conditions, authorised servicing and reasonable access
for assessment, but these requirements do not limit rights that
cannot lawfully be limited.

13
Responsibility

Liability

Nothing in these Terms limits liability for fraud, wilful
misconduct, death or personal injury caused by negligence, or any
other liability that cannot lawfully be limited or excluded.

Subject to the Non-Excludable Rights and to the maximum extent
permitted by law, neither party is liable to the other for indirect
or consequential loss that was not reasonably foreseeable when the
relevant contract was formed. Project-specific risk allocation,
insurance and any agreed liability limits are governed by the
applicable project contract.

14
Ownership

Intellectual Property

Unless stated otherwise, we or our licensors own the website,
branding, text, graphics, photographs, videos, drawings, layouts,
catalogues and other website content. You may view and print content
for your own legitimate project evaluation, but may not reproduce,
modify, publish, sell or commercially exploit it without permission.

You retain ownership of plans and material you submit. You confirm
that you are authorised to provide them and grant us a limited
licence to use, reproduce and share them with relevant personnel,
consultants and suppliers as reasonably required to assess your
enquiry or perform an agreed project.

15

Privacy & Communications

We handle personal information in accordance with our
Privacy Policy. By submitting an
enquiry, you authorise us to contact you about that enquiry or
project using the details you provide.

Marketing communications will be sent only where permitted. You may
unsubscribe using the option provided or contact us directly.
Service, safety, account and project communications may still be
sent where reasonably necessary.

16

Third-Party Content & Downloads

The website may link to maps, videos, social platforms, suppliers,
standards bodies or other third-party websites. These links are
provided for convenience and do not mean we control or endorse all
third-party content, terms, security or privacy practices.

Catalogue and specification downloads are general publications and
may be superseded. Confirm the current revision and project-specific
requirements with our team before relying on downloaded material.

17
Website Security

Acceptable Use

You must not use this website to:

  • break any law, infringe rights or submit unlawful, deceptive or harmful content;
  • introduce malicious code, probe security, gain unauthorised access or disrupt availability;
  • scrape or harvest data at scale without written permission; or
  • impersonate another person or submit information without authority.

We may block activity that reasonably appears unlawful, unsafe or
harmful and may preserve or disclose relevant information where
required or permitted by law.

18
Resolution

Complaints & Disputes

If you have a concern, please contact us with your name, contact
details, project reference and a clear description of the issue.
We will review it and aim to respond within a reasonable time.

Before commencing formal proceedings, each party should make a
genuine effort to resolve the dispute through good-faith discussion,
unless urgent relief is required or this would restrict a statutory
right. You may also contact the relevant consumer protection body or
obtain independent legal advice.

19
Jurisdiction

Governing Law

These website Terms are governed by the laws of New South Wales,
Australia. Subject to any applicable statutory right to bring a
claim elsewhere, the courts of New South Wales and courts entitled
to hear appeals from them have jurisdiction.

A project contract may specify its own governing law and dispute
procedure. Mandatory laws, including applicable consumer protection
laws, continue to apply.

20
General

Changes & General Terms

We may update these website Terms by publishing the revised version
and its updated date. The revised Terms apply to website use from
publication. They do not retrospectively change an existing project
contract unless the parties agree or the contract or law permits it.

If a provision is invalid or unenforceable, it will be read down to
the extent necessary or severed, and the remaining provisions will
continue. A delay in exercising a right is not a waiver. Headings
are for convenience only.
